By accessing and using My Yard Sale Listing ("the Service," "we," "us," or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

These Terms of Service apply to all users of the Service, including but not limited to sellers who list yard sales and shoppers who browse listings.

My Yard Sale Listing is an online platform that connects sellers hosting yard sales, garage sales, and estate sales with local shoppers. We provide:

• Interactive mapping tools to display yard sale locations
• Listing services for sellers to advertise their sales
• Search and filtering capabilities for shoppers
• Payment processing for listing fees

We act as a platform facilitator and are not responsible for the actual transactions, items sold, or interactions between sellers and buyers at yard sales.

3.1 Listing Requirements

When creating a yard sale listing, you agree to:

• Provide accurate and truthful information about your sale
• Include a valid address, date, and contact information
• Not post misleading, fraudulent, or illegal content
• Only upload photos that you own or have permission to use
• Host your yard sale as described in the listing

3.2 Listing Duration

Listings are active for the duration specified in the package you purchase (Weekday Special: 4 days, Weekend Premium: 2 days). After this period, listings automatically expire and are removed from public view.

3.3 Prohibited Items

You may not list yard sales that primarily feature:

• Illegal items, weapons, or controlled substances
• Counterfeit or stolen goods
• Hazardous materials or recalled products
• Items that violate intellectual property rights
• Live animals (except for adoption events with proper documentation)

4.1 Listing Fees

Listing fees are charged based on the package selected:

• Weekday Special: $5.99 for Sunday-Thursday sales (4-day listing)
• Weekend Premium: $9.99 for Friday-Saturday sales (2-day listing)

4.2 Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service. We do not store your payment information.

4.3 Refund Policy

Listing fees are generally non-refundable once your listing goes live. However, we may issue refunds at our discretion in cases of:

• Technical errors that prevent your listing from displaying properly
• Service outages exceeding 24 hours
• Duplicate charges or payment processing errors

5.1 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Post false, misleading, or deceptive listings
• Harass, threaten, or harm other users
• Spam or send unsolicited communications
• Attempt to gain unauthorized access to our systems
• Scrape or copy content without permission
• Interfere with the proper functioning of the Service

5.2 Content Ownership

You retain ownership of all content you submit (descriptions, photos, etc.). By posting content, you grant us a non-exclusive, worldwide license to use, display, and distribute that content on our platform for the purpose of operating the Service.

5.3 Content Moderation

We reserve the right to remove any listing or content that violates these terms, is reported by users, or that we deem inappropriate. We are not obligated to monitor all content but may do so at our discretion.

6.1 No Warranty

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

6.2 Not Responsible for Transactions

We are not a party to any transactions between sellers and buyers. We do not verify the accuracy of listings, the quality of items sold, or the conduct of users. Users interact at their own risk.

6.3 Limited Liability

To the fullest extent permitted by law, our liability is limited to the amount you paid for listing fees in the past 12 months. We are not liable for indirect, incidental, or consequential damages including lost profits, data loss, or personal injury.

6.4 User Responsibility

Users are responsible for:

• Verifying the legitimacy of yard sales they attend
• Their personal safety when visiting or hosting sales
• Inspecting items before purchase
• Complying with local laws and regulations
• Obtaining necessary permits for hosting yard sales

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason including:

• Violation of these Terms of Service
• Fraudulent activity or payment disputes
• Multiple reports of misconduct from other users
• Posting prohibited content or items

Upon termination, your active listings may be removed, and you may forfeit any remaining listing duration without refund.

8.1 Changes to Terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the new terms.

8.2 Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of [Your State/Jurisdiction].

8.3 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.
